This sucks Clem. How in the world can a judge or a court system think its is in the best interests of a child to seperate a father from a child. I think your ex wife should be ashamed. If your state court system will probably go against you it might be better to take the money you would spend on a lawyer and apply it to moving to FLA. I hope it works out Clem.

Perhaps a job (even it's part-time) would not be a bad idea. Can't be a good thing for the custody battle to have gambling as main source of income.

Hey Clem, I have gone through the exact same situation in another state. Had almost the same type of language in my agreement. When push came to shove and my ex realized I was going to fight her leaving with everything I had, she chickened out and moved without my son.

It turned out for the best because now he is with me all the time. She was caught up in love and made a poor decision.

I am an attorney, (although not a domestic law specialist) and in most states it takes a substantial change in circumstances to set aside a court approved agreement. I think if you fight, she will either stay and you are ok or she will leave and you will keep him. hang in there -- Triz
