NEWSMAKERS: Cody's No Monster!

Cody Gifford is not a monster. So says the spawn of Kathie Lee Gifford who today filed suit against a supermarket tab for an article that said the 10-year-old towheaded tyke was a real ... incorrigible individual.

The court action was filed in Palm Beach County, Fla. The defendant is the Examiner.

The Gifford camp says the Examiner flat-out made up stuff for its Feb. 8 article, "Kathie Lee's Turning Poor Cody into a Monster." The story said Cody had been a pain during production on "Model Behavior," the ABC TV movie that marked his acting debut. No comment yet from the Examiner.

Little Cody Gifford just hit the double digits, but he's already become a ripe target for supermarket rags. Now the family's biting back, filing a multimillion-dollar lawsuit in Cody's name against the National Examiner.

Lawyers for the 10-year-old tyke (oh, yeah, and his mother) claim the American Media-owned Examiner played loose with the facts for its latest chapter in the Gifford saga, claiming Kathie Lee's mothering turned Cody into a spoiled brat. The tab's February 8 cover declared, "Kathie Lee Wrecking Cody's Life! Pushy Mom's Creating a Monster."

The tab's proof? The Examiner claimed witnesses saw Cody throw tantrums on several occasions--including a trip to an Italian restaurant, a visit to an exclusive kids'-clothing store and an excursion with his nanny to a Sam Goody music store. (The tab also claimed Cody started crying when he found out Britney Spears' latest album was sold out, but don't we all do that?)

The paper also reported that Cody's costars in the ABC TV movie Model Behavior said his behavior was anything but model.

The Giffords deny any of it ever happened, adding that the Examiner painted Cody as an "unruly child who is unable to behave in a socially acceptable manner."

"The statements are defamatory per se in that they falsely depict Cody as a wanton, willful and unremorseful destroyer of other people's property," the complaint reads. "This depiction is absolutely false and tends to subject Cody to hatred, distress, ridicule, contempt and disgrace."

Gifford's lawyer, Barry Langberg, says it's unfair to trample on little Cody, who made the final decision on whether to sue. "The entire family thought it was pretty shocking they would go after a 10-year-old boy," he says.

The suit names American Media as a defendant, as well as the story's writers, Michele Burgh and Lauren Elkies. Representatives for the Examiner have not returned calls for comment.

Sidebar: Pick a Gifford, any Gifford. The Florida-based American Media has had a long love affair with Regis' perky cohost and her former-football-star hubby.

The company's Globe tabloid once went all the way with Frank and his well-endowed onetime mistress, publishing transcripts of their alleged sexual encounter and getting into the details of their subsequent fallout.

But dear little Cody's lawsuit ignites an age-old Kathie Lee debate: Is this what she gets for parading her kids in front of our faces all those years? Or should those Gifford-hating sentiments simply stay clear of their unassuming offspring?

It's a question as vexing as the meaning of life.
