I know he's being charged with intoxication manslaughter but I don't think he should be. If I'm out drinking with a buddy and he's driving I have a good idea how much he's had to drink and to me if I get in the car with him driving them I'm no less at fault than he is by allowing him to drive and riding with him. I know it's not that simple but it's how I feel. Now if he killed someone in another car because he was drunk then that's a totally different story.

Either guys could have called a cab. The rider could have said no, you're drunk but he didn't and most of us never do. I can't tell you how many times I've sat in the passenger seat and thought to myself how stupid it was because I knew my buddy had too much to drink. At that point I made a choice and anything that happened was by my choice.

Maybe I'm seeing it wrong but at this point it's how I feel.

I don't see how one life is valued differently than another?

If two buddies decide to rob a bank, and a shootout results. A bullet from one friend accidentally catches the other criminal and dies. Under your theory, the living bank robber should not be charged for murder. However, if an innocent bank customer was shot and died, then a murder charge should happen?

Yep, it would be your choice and you would share in the blame. That does IN NO WAY exonerate the driver.

Just to be clear here, he got drunk, chose to drive, with a passenger and killed that passenger.

Other than the fact that you are a Cowboys fan, I fail to see how anyone in their right mind could make the argument that the driver bears no responsibility in the death of another human being.

I kinda see your point here..He was an adult who chose to ride with a drunk driver just like the driver was an adult who chose to drive.

What baffles me is why these idiots were on the road in the first place. The cowboys have a 24 hr hotline they can call with complete confidentiality. They call if they can?t drive or in trouble and individuals show up and one drives them home, the other drives their car home. Completely free of charge and no questions asked. Why not use it Why??? I would use it every weekend:shrug:

100% agree. No excuse whatsoever and he will have to live with that the rest of his life as it was his buddy.
