Legal Question

Guys...

I was in an auto accident last October. The short of the story is that I was on my way into work and I was hit by another truck. The truck's right front wheel FELL OFF and he collided into my drivers side door. The impact put a hole in the door and consequently snapped my femur in 3 parts and bruised my hip.

The jackass had the adacity to get out of his car and come up to my window(or what was left of it) and the first thing he says to me is "sorry, these things happen"...as I am laying across the console in the most pain I have ever experienced. He follows that fine comment with this one.." hey, can I use your cell phone?" I turn to him and, as politely as I can, say "no", can I use your leg cuz I sure as hell am not going to be able to use mine for the next 6 months or so.

Anyway, the medical bills to date total roughly 50k. My question is this...what type of settlement do you think that I will see? I do know that it was a company vehicle and that their insurance policy has "substantial" limits up to a million. Any lawyer types in the house..

Just pullin your leg (pun intended). As I've indicated in other threads you can't value or predict a case unless you have as many facts as are available. Although you do a nice job in describing the collision, in order to determine what you have to look forward too, much more info is needed.

I.e., what you do for a living, your lost wages, future lost wages, future medical expense, the permancy of the injuries, whether its a comp claim or third party claim, the identity of the insurance company representing the guy who hit you. I'm just scratching the surface.

Your lawyer can answer these questions. Remember(bit of advice) litigation is no fun. Picture yourself standing in front of the crap table at the Argosy Casino in Lawrenceburg, holding the dice in your hands. Thats where you are. I wish you a solid recovery and luck in the future.

Been to Argosy many a times and if the craps table is what you are comparing this to...uggghhhh!:mad: BTW..his insurance is through Hartford.

Unfortunatley Pacer, so have I, so haveI. That son of a bitch is only 30 minutes from downtown Cincinnati. Way to close.

My experience with Hartford was that they aren't too bad. Thank God you don't have Allstate or Nationwide. By the way, as I tell my clients, if any of you insure with Allstate or Nationwide, you WILL be sued if you are involved in an auto accident.

They do not settle there claims. They know most lawyers do not want to try cases and they make them do it. If you have Allstate or Nationwide, change to any other carrier so that you aren't dragged into court.

Good luck in your case PF. By the way went to Conseco last sunday for the first time. (pacers/philly) Love the inside but the outside looked kinda funky. Your town has done a lot. Nice downtown.

yes..I have lived in this fine city for 25 years and Conseco is one change that was for the better. Market square was great b/c it got so loud in there..but conseco is VERY NICE and has a great atmosphere. Sidenote..My insurance company is nationwide. they cut me a check last week to cover some of my medical bills.

If your carrier was nationwide, I assume they either paid you pursuant to your medical payments coverage or pursuant to no-fault ( I don't know if Indiana is a no-fault state). They are required by contract to do that.

My situation calls for when you cause an accident and some third party is seeking recovery from you. In that scenario, your liablity coverage will come into play and nationwide does not pay third parties so you will get sued. Thats my point.

If you are at fault and you have Allstate or Nationwide, you will get sued because they won't fairly compensate the person you hit. Theyare always in Court kids.
