rental help please

hey guys, i thought someone might have had similar experience renting out room's, so i thought i would ask for advice. i work in realty, but i want to keep my bosses out of my personal affairs.
i currently rent a room to someone, she pays her bill's, but she is always a week or so late, this isn't really the problem, i can handle being late.
she has a revolving door of guys going in & out of her room. i only agreed to her renting the room, not people staying there 24/7. she lost her job, so she is at home 24 hours a day along with whomever the guy of the day is. along with her never paying for food and taking whatever she wants out of the fridge, without replacing it. i have given her written notice of my problems with these things, and asked for them to stop, but it falls on deaf ears. we have a month to month deal.
i'm curious what my rights are to get her out of there.
she is respectful in many ways, this isn't a nightmare for me yet, but it is ridiculous to wonder if the stuff i buy is going to be there when i show up at home, or who is in my house. her guests are there more than i am and it's my house.
any advice?

My advice is to notify her in writing that by September 30, 2005, she needs to have vacated the premises.

You didn't mention if she has kids or not? Hope she doesn't. It's hard to get rid of bad tenants sometimes, but hopefully you won't have this trouble. GL!

Rules will differ from state to state. Give her a written 1 month notice to vacate, that is very generous(mail....certified, or have her sign paper that she is receiving it !!) and get her out. Explain that rent must be paid for this 1 month or you will see her in court. Some states don't require that long with month to month & week to week,, it is immediate.............get out when notified, so as a realtor, you should know what your state dictates.. It is a bad situation in addition to not knowing who is in/out of your house. GL & really hope you don't need it.

Hmm. Maybe you need to start demanding head from her for the groceries. Kidding (sort of). Wow, seems to me like if its your house and she hasn't got a lease tell her she's got to find her own place. Tell her you want to convert the room to an office or something or your brother is going to be moving in or anything.

What if she gets busted for Prostitution? Are you liable as running some kind of bordello? I have learned the hard way not to be eager to help people out if it involves them living with you or you supporting them.

Get my e-mail from admin, I should be able to steer you in the right direction. Even though she is month to month, she still has rights, etc. I remember reading that AR182 is an investor as well and may be able also help. Don't worry, you'll get this bitch out legally.

Mjolnir, is there ANYTHING in writing?? (does she have any type of agreement that says she *rents* rather than that she is a roommate?) if not, and it is just a roommate situation, you can have her out within the hour :D

so far she is really passive, i haven't asked her to leave i just want her to buy her own stuff and keep the overnight guests to a minimum. i just wanted to know if i had the right to boot her if needed. one of her guests tried to convince me to let him grow pot in my house.
i have a feeling that if i pushed it she would be out quick, she doesn't seem vindictive. but if it got ugly i would throw her crap in the front yard, and change the locks. i just would hate for some dumbass she is dating to try and get on her good side by messing with my dog's or my house. then it would get ugly quick.
i appreciate everyones advice. even the hit it and make her leave. too bad she acts like a ho.

Whatever you do DON'T TOUCH HER STUFF!!!!!!! If you touch it and u go to small claims court your toast.......She has more rights than you do at this point.....Get a notice to quit fill it out and take it to your local police (usually a small fee involved) they will put her on notice that she has xxxx amount of time (in Maine 30 days) to vacate.....If she hasn't left by that time notify police and they will come and remove her...........Hope things don't get ugly and hide your valuables.........

the roomy moved with no notice, while i was at work. i'm very happy. with the money she had put at a deposit, once her final utility bills are paid i might even owe her a few bucks.if i count the food she ate then we're probably even.
i appreciate the sound advice.

i have never rented out a room to somebody & haven't seen the lease but i do have an opinion on this.

i would get her & her belongings out of your house asap.

you have strangers walking freely through your house. that would make any homeowner nervous.

i would give her a hand delivered or certified letter telling her she has 30 days to vacate the premises.i'm sure she will try to play to your feelings & ask you why & that she can't afford moving.you have to remember to deal with this in a business manner. tell her that you re-evaluated renting out a room to somebody & you feel that it's not in your best interest to do so & that you want your privacy back.

if she still complains that she can't afford moving out, you should tell her that you will make it worth her while. you may disagree with giving her a monetary incentive, but i have read a few articles that all say that if a landlord is in an undesirable rental situation a monetary incentive is the right move.

first offer to pay for a moving van (but don't get the van under your name) & if she still stalls then mention that you will give her $50 -$100 plus the cost of the moving van once all of her belongings are out of the house (not before).

in other words do whatever you can to get her to move out of the house.

if she still refuses to move out, you should tell her, in writing that you will change the locks in the house in 30 days & if by then she hasn't moved out, you will then put all of her belongings in storage.

the bottom line is that you have to get her to move out asap & change your locks asap.

make sure you have everything in writing & proof that she received any of your written correspondence.

i only enter into long term leases. i refuse to enter into 1 year leases.

FRANKIE, LUX, AR182 or anyone else who can help,

I own a couple of houses (rental property) and am considering selling them. Haven't listed them but have gotten people asking about them (word of mouth) My question is if I hold the mortgage, 10% down, 30yr, with 8% interest and a balloon payment after 5yrs is this something beneficial to me. Don't know alot about that and obviously would have a lawyer involved but really would appreciate your opinions... thanks :cool:
