It's fucked up. There's no doubt that was unnecessary and done because he was black.

If it was me, I'd probably hand him the can, he would have smelled it, if it was just the sweet tea, he would have returned it and it would have been over with. With that said- I can't put myself in that situation or understand what it's like to be a black male. I would imagine, that if I dealt with that harassment and similar things repeatedly over time, then no, I would not have handed him the can.

I'm in the minority and I know that, but I just don't see what is wrong with avoiding the whole situation by letting the guy see the damn can of iced tea.

I know, I know, everyone is a super tough guy and ain't no way I'm showing that cop anything I ain't gotta!

I get it, but dude went to jail and spent 18 months sorting this out and apparently lost his job over it. Seems like given the choice it might be easier to just let the a-hole cop see the damn can. I agree the cop was an asshole, but sometimes picking the lesser of two evils is the way to go.

The cop associates being in the parking lot, where there is liquor and alcohol being purchased? I am on the brothers side, the cop is a total dick and should have taken his word once he saw what the can stated as the contents. We are guilty till proven innocent now days and that sucks......... JMO :0008

He thought he was being a public servant and busting someone for drinking in public. He realized he made a complete ass of himself + on camera. He flexed his muscles and abused his power. I'm sorry but guys like this need shit canned. This isn't his first instancs, no way. Whether you like how the "brother" handled it or not. He handled it 100% within his rights and did no wrong.

He certainly did, the cop also handled it within his rights. Both had options to handle it better and neither chose to. Situation could have been avoided if either one chose to use some brains, but both chose to let their ego get in the way.

Maybe the cop was responding to a complaint, maybe there had been problems in that lot before, who knows? None of us, you, me or anyone know what was actually in that can. Maybe it was booze, who knows? Several here brag about how they sneak liquor into NFL games so it isn't out of the question he did have booze in there.

In a situation like this, if you have nothing to hide, you can be a bad ass and spend the night in jail and the next 14 months sorting it out or you can let the cop have a look at what you are drinking. I'm gonna take the easy way out and go on with my life.


On the other side of the story it is disappointing (though again we don't know all the details) that apparently the DA said he was upset the charges were not pursued. What he should have been disappointed in was the way the cop handled the situation and maybe used the whole thing to teach how not to develop relationships with the public. Big egos on either side just lead to crap like this.

I cannot necessarily disagree with what you have said. The egos thing is definitely a good point. I just think in the bigger picture, the cop has better things to do. Those guys weren't being obnoxiously loud or disturbing the business. They appeared from the sound of it to just be waiting on someone.

But like you said, and as always, we don't know the entire story.

On Thursday, Cumberland County District Court Judge Lou Olivera agreed with defense lawyer Allen Rogers? motion to dismiss the case based on a lack of reasonable suspicion for a stop.

Olivera ruled the stop was unconstitutional, and therefore, all evidence gathered from the stop was inadmissible. He referred to the legal metaphor ?fruit of the poisonous tree,? which is used to describe evidence obtained illegally according to law.

I, too, would have been arrested. While I obviously am respectful of cops and follow their instructions when I'm pulled over, I would not have given that out of uniform cop my can of iced tea if approached in a parking lot. The cop needs to come to me with a badge out up front identifying him as a police officer before I offer him the respect that he deserves. If he Badgers me, then presents his badge after the fact, it's too late. The black man did nothing wrong. The white cop was 100% off base. What's more absurd is that an actual drunk man came by and the cop didn't have the word to say about it because his ego had already taken over

I'm also not sure you read what I posted. When someone pulls out in front of you and you have two choices:

1. Hit your brakes to avoid the collision.
2. Hit the car because AIN'T NO MOTHERFUCKER GONNA PULL OUT IN FRONT OF ME!

I'm guessing you chose #2, congrats, you are a certified bad ass and you showed him. Your car is still wrecked and your day is fucked and your car will be in the shop and you better have a witness or you're likely paying your deductible, but you showed him, absolutely.
