I have a question regarding legal jargon.

Does the word "shall" imply 'must', and should is more optional??

Specifically:

"The employee's customary work week shall be between x and y hours"

If the hours were cut back to fall out of that range, is the employer in breach of contract?

The following statement is included: The Employer may change the working hours of the employee at any time, provided prior notice is given".

How would you define working hours? That could mean cumulative hours or it could just mean a change from 8-5 to 10-7.

My interpretation is that the former statement means if my employer doesn't allow me to work the set hours of our contract, they are in breach. The latter to me gives leeway to how the hours are structured vs the actual # of hours-

long story short i'm getting completely fucked at work. if i leave without 45 day notice, i forfeit some back salary i earned. my stance is that my leaving is due to my contract not being fulfilled and i should get said payment. for those who ask...i would give her the 45 day notice but if/when i do she has such a temper she would not let me finish it out. i'd prefer to work until sept 1st and notify her mid july but then she will tell me to walk mid july and we aren' tin a position to leave yet. complicated stuff

btw people have posted dental questions and i was glad to help out here at MJs. but i don't operate like a lawyer...charging by minutes and typed letters.

That was me, but it wasn't about saint, it was about 'Dr.' Freeze.
