geez, this thread reminds me of going to the prisons and listening to the positions of the jail-house lawyers, who ply their trade for cigarettes and other "favors." always wondered why, if they're so smart, are they all in prison?
wonder why all the tobacco plaintiffs don't sue the billboard and media advertisers who take money to advertise a known carcinogen? as pointed out in yyz's post, there must be a duty owed to the plaintiff by the defendant to use reasonable efforts to discover that which was misrepresented. further, the plaintiff's reliance must be reasonable. let me see, we got the offshore gambling industry, considered a criminal enterprise by all 50 states and the federal government, that is widely known to be riddled with corrupt or insolvent operators. i guess the conspiracy theorists here think jack has a duty to get a certified financial statement from all potential advertisers at this site. so now those great legal minds here want to bring a lawsuit to recover their deposits lost from investments in an unstable industry that is deemed illegal everywhere is this country. all i can say is that must be some good s*it you're smoking.
