OK, you all talked some sense into me but here's the problem now. My bank won't let me re-open my account. They also said anything that comes to them for payment will just bounce...so then Neteller will have to come after me directly...is that still bank fraud? Can they come after me since they are not in the US??

I had seen you post that before.

Does it make any difference that neteller is in Europe and not the USA? Does it make any difference that this might be an "illegal" transaction?

thanks. I'll also repeat this was not a cool thing for him to do and I'm not condoning it. Just wondering about the consequences this new legislation might have.

I know that an illegal contract in not enforceable, but I know about nothing about the inner workings of neteller and banks. thanks.

The illega contract is a little tricky but it usually doesn't hold much ground

I personally don't think it will make much of a difference if its USA or Europe...if the chit bag withdrew the money from his net teller account they will come after him...I think its all defined in the terms and agreements when you first sign up for net teller...trust me they'll get their money and then some when its all said and done...I don't think he'll be able to dispute this with net teller since he's depositing funds into his own account...and there is a good chance net teller files some kind of criminal report

as for the bank this would be a considered an Electronic Funds Transfer dispute and every bank handles it different but the one I work for you would have to fill out an affidavit that has been notarized...you lie filling one of these; there will be repercussions...the bank will research the transaction and investigate...since this is a closed account the bank won't give a chit and will return the transaction as an closed account...the bank will proceed with basically making sure this dumb ass doesn't have the ability to open accounts in the future along with making sure that other banks are notified for any other accounts he may have...he could get another checking account but it will most likely will have to be in another state...bottom line the term bank fraud will follow this guy around unless he changes is social security number...lol...

This is a road this guy doesn't want to walk down...

bank fraud is bank fraud...I'm thinking this account was a force closure because they won't let you re-open it...so there might be some other issues your dealing with...I would call, email, whatever it takes to make sure that net teller will get their money...I'm not real sure how they'll handle this but you need to make sure that your current bank wont report you for fraud or any other reasons due to your mistakes...you'll might have to pay some fees...but do not drop the ball on this

I am going to have to call BULLS**T on this one.

Is it possible to make a Neteller deposit and them not instantly pull the money out of your bank account? I have never seen a delay when I have dealt with them, the transaction has posted instantly on my account.

And if it isn't a BULLS**T made-up story... then my take would be that the bank could press charges on the person along the same lines of intentionally bouncing a check, and since it was a decent chunk of change, could it be considered grand larceny, which is a felony?

I was thinking the samething as I was typing my reply...I can't see them releasing the funds until the deposit has posted...I think someone is just testing the waters to see what would happen...
