Just out of curiosity, did the said employee file for unemployment? A few of my friends that own small businesses have had similar things happen to them. Get a bad employee, gets fired or quits and never shows up, and then files for unemployment.

Also, they have said the State always sides with the employee and gives them the unemployment. I know businesses (large and small) have unemployment insurance. However, I've heard this can really put a drain on cash reserves. That could be expensive.

Just what I need if I decide to start a company....ugh.....

We had a mechanic who was less than average at best- He was a young kid out of school and he came to us when he applied for the job with a list of "demands". Such things as starting off with two weeks vacation, hourly rate, etc etc. He was here maybe 3 years if I remember correctly. He decided that his raises weren't high enough so he started looking for another job and made sure he mentioned it everyday. He also decided that he didn't feel like working much either. Now this is a kid who doesn't know how to diagnose problems on vehicles but you tell him what was wrong he could more than likely fix it given a little guidance. So of course he isn't going to get a top mechanical pay rate. Plus any mechanic in a small shop like ours is not going to make dealer pay either. So anyhow- he decides on his downtime he will fart around on his cell phone instead of cleaning his bay, call his girlfriend while replacing brakes, and just not really do anything else that was expected of him, so finally after we told him time and time again that we would not meet his "new list of demands or I'm quitting right now" he was sent down the road packing. Of course he got the job at the other place and then on top of that filed for unemployment telling PAUC that he had to leave us because of unfit working conditions. Of course every quarter you pay your taxes into PAUC and when an employee leaves they use your payments into them to pay out if they consider the employee eligible. Well unfortunately for him when I responded to his petition for benefits they denied his request- although they did give him a partial payout from the "General Fund". Not from our fund so it had no affect on us. They only gave him a few weeks of benefits because he had his other job and then the case was closed. In my letter of course I explained his skills vs his pay, that once he demanded more pay he decided to slack off when not compensated, cell phone use during hours, and lack of following other work duties. Now if he wouldn't have had the new job they would have continued to pay him through the general fund as long as they would have allowed.

Then of course you have bosses who intentionally screw their employees- a friend of ours works for an excavating business. The owner decided to lay him off 3 weeks before the cut date that he could collect unemployment. This also happened to be the day the boss left for Florida. When our friend asked about staying on until he could collect the boss said "ain't my fucking problem".

Anyway, he flipped out on me and told me that he was leaving the site after the Hippo contest was over. So, to make it easy for him so he wasn't tempted to post (since he was leaving anyway) I banned him from everything BUT the Hippo Contest.
