Anyone ever get DWI? need advice

I was pulled over for a DWI this weekend, and was wondering on what I should do. Would it be best to get an attorney to try to get some charges dropped or lessened, or just go in and plead guilty and pay the fines and probley get my licence suspended for a few months?

I know the laws differ in every state but most likey the process is about the same everywhere. I am located in Nebraska, but was hoping someone had some experience and was wondering what the best route to take would be.

I don't have the fund to purchase an attory, so I would probley have to get a public defender, but do I need to go and talk with them before my court date to set something up or to they take care of that the day of the showing? I have never been to court before and would like to know the process and need any advice to get the lowest charge assessted.

I know I f*cked up, and what I did was wrong, but I was hoping with an attorney I would be able to keep my licence and maybe just get a few months probation.

Although I have never had a DWI I can maybe help you a little, but since state laws vary so much it could be wrong. First of all, did you blow? If so, was it over the legal limit? If the answer is yes, stop here and don't even think about a lawyer and go plead No Contest. If you blew and it was borderline or if you refused then you may want to get legal help and try to get it pleaded down to reckless Op. More than likely if you go to court they are not going to give you a public defender since your offense is not a felony but that depends on jurisdiction bylaws. There are so many scenerio's with your question that are unresolved to really say yes or no, were you in a accident? how is your previous driving and criminal record? will the loss of your license affect your ability to earn a income such as a truck driver (CDL). If you blew over the legal limit then there is not much any barrister can do for you.

it's not a guarantee that you would get a PD too. If the judge wants to be "frisky", he can order you to pay it back at 20-50 bucks a week until it's paid.

Just don't get anymore, lesson learned.

Yes, they had me take a breath test and it was well over the legal limit. They also took me to the hospital for blood test for evidence.

What happens if I was to pleade no contest?

There was no accident, I was just swearving down the road, and they said I swearved up onto the curb, so he pulled me over.

I have had fairly good driving record, just a few speeding tickets is all.

Your best bet is to go in and plead "no contest" since you really don't have a leg to stand on. Usually first time offenses are sentenced according to the state's mandate for DUI's, in Ohio the first offense results in: 1. 30 days in jail with all of the time suspened upon completeion of a drivers intervention program. 2. 6 month's license suspension, 3. Reinstatement fee's to get license back at $425, 4. Fine for DUI of $300. You may want to go to your state's attorney general offices web site and see what the mandated penalties in Nebraska are.

Magic they may take your license but don't let them take your pride too. The damn cops got me 4 times in my life, don't play their game, never play their game. Last time they took my license away for 6 months. I still drive but get very nervous when I see cops around. I'm ok now so I mostly let my wife drive when I've been drinking, but not always. Best advice: When drinking, always look for cops and stay on the road. Good Luck. ;)


If you blew, you are screwed. Don't waste money on an attorney. Let this be a lesson to all. If you think there's any possible chance that you could fail a breath test, refuse it. I'd refuse the field sobriety test even if I hadn't been drinking. Fawk that! Yes you'll go to jail for a few hours, but you'll never have a DWI on your record!

I got 1, and was advised not to get a lawyer. I blew right at the legal limit twice. Which in Nj is .10,
I got a lawyer and got it pleaded down to a reckless driving with
5 points, and a 30 day loss of license. I argued the validity of the stop which was a cop hiding behind a bush who said I was speeding. I knew I wasn't and I also had a radar detector that did not go off. Long story short, I was coming from the next town over at a fantasy football draft with 10 cops from that town. They alerted me that the town I got stopped in only had two radar guns and the chances of the cop who got me had one were slim and none. My cop friends also gave the arresting officer a hard time for not cutting me a break and making me walk the mile to my house and towing my car. The arresting cop was willing to let me deal for the lesser charge provided I took a small suspension.
Which I was very greatful for as surcharges in Nj wind up being about 10 k over 5 yrs.

Hold on, hold on , hold on--first of all, my father is a Attorney-and a town prosecutor--I know states differ in their laws and sentence guidelines-but you should never -ever refuse a breathe test unless you just killed someone with your auto--lawyers and judges have a saying "you refuse you lose"-meaning if you refuse the test they will find you guilty of DWI in court-trust me-the judge will believe a cop over you every day....Second =always get a lawyer ALWAys-YOU DONT WANT TO PAY? wELL GUESS WHAT-YOU WILL PAY WORSE GOING IN AND PLEADING GUILTY (FINES -COURT COSTS-INSURANCE ETC)--with all the lawyers out there you can find one fairly cheap---if you need any advice I could even ask my father for you-but get your own Attorney PLEASE:) :D :cool:

No disrespect to anyone, but listen to the Worm and get a lawyer, period. I could tell you a long story about one of our former employees and his dealings with this same issue, but he ponied up and got a good attorney and it was the best money he has ever spent. He watched people at his court appearance get thrown in jail for first offense and NO attorney. Its a big racket, and judges don't like you going in there trying to defend yourself and not putting money in their pocket especially if you blew quite a bit over the limit.

Find some money and get a lawyer. You will be sorry if you don't. Good Luck

He may be able to get the punishment reduced. He might possibly get the charged reduced to reckless driving. He might be able to get driving privileges so you can go to work.He may be able to do a lot of other things for you.
At the very least talk to one who does DWI work. You won't regret it.
You try and go it alone and you're a dead duck!!!

all I have to say is lucky that you are in the USA.......can't get much lighter on DWI then in the States.........:nono:



in some countries you'd be in deep sh** that's for sure......:eek:

Worm44, You are the first person I have ever heard say that you almost always should blow, I have always heard that you NEVER blow unless you are 100% positive you will not exceed the legal limit...:shrug:

It's moments like these that I am happy to segregate myself from the rest of the majority in America...

How come:
We expect our leaders - Bush, Cheney and the whole gang - to be held to the very last detail of truth in anything and everything they say and do. When one of them even flinches it seems as if the entire world is jumping down their throats and questioning them...
We expect them to not:
Lie
Embelish the truth
We expect them to:
tell the truth
take responsibility for your own actions

And then take the topic of DWI's in public america.
Someone goes out and gets a DWI/DUI and the very first thing out of their filthy lil mouths (95% of the time anyway) is "oh its not my fault, oh it wasn't a legal traffic stop, oh dont blow in the breathalizer - its a big trick! blah blah blah"

People make their livings coming up with these ridiculous excuses to avoid facing the music of a DWI that they did.

It's not like its a big f*cking surprise when you get pulled over for driving after 12 beers that you are gonna get hit with a DWI. People know this and still roll the dice. And then when they crap out they come up with a million excuses as to why they should be "forgiven" for endangering the lives of everyone in the vicinity of the road they are on.

Sorry is not waking up the next morning and seeing your DWI papers.. that's what we like to call "regret" big difference.


So next time everyone goes out bad mouthing your leaders about what a chitty job they are doing and how they are never honest at all... remember your uncle/cousin/brother/father that weaseled their way out of a DWI because they argued the moon was full that night and caused a glare on the windshield which caused them to swerve which made the cop pull him over for a sobriety check that they failed and then blew a .12 BAC - but it wasnt their fault.

It makes me freaking SICK!
