thats funny because george bush tried to weasle out of his arrest for driving under the influence by leaving the question that reads: have you ever been arrested? blank on his presdidential application.

LOL, I think he has been doing the same thing since he was elected leaving everything blank for the general public. Hopefully now that both Iraq and Afghan invasions are in turmoil due to poor planning our elected officials will sack up and start demanding some answers.

up here, the penalty for refusing a test is the same as for failing a test...so not wise to refuse

Not sure if it is actually then called a DWI technically, but consequences the same...and perhaps harsher treatment because of the refusal

Get a lawyer, take it from me it may be the best cash you can spend. ALso enrole in some form of AA or community service regarding drinking. Was charged over 10 yeaqrs ago and got 6 months no licence and $525.00. Very luckey. The fines went up the next year to a minumum of 1year and 1200. In Canada you are charged with refusing the breathalizer. Carries same pen. ALso check your insurance rates mine went from 1200 a year to 4600 for the next year and then decreased each year after for five years.

Let me elaborate (this comes staight from my father a prosecutor)----In almost all states if you do not blow, the case will go to trail and they will have to prove that you were drunk. This is easier than you think-the Prosecutor will get the arresting officer on the stand and ask him why he pulled you over-now chances are you were crossing the lines in the road ,going to slow, going to fast etc-whatever-the judge is going to believe the officer when he says you smelled of booze, slurred your speach etc.......Now, if you go througha ll that in trial because you did not blow--you will get a stiffer penalty and fine than if you blew and got a lawyer to plea bargain for you..........By the way-In New york were I live, if you refuse to blow you automaticalley get your license suspended for a year and convicted of the charge 99% time and pay a whopper of a fine. Get a lawyer---any other questions I will gladly ask my father and respond......:) :cool:

I agree with worm on this one. When I got my second, yeah I know I was young and stupid, I refused. Once I got to court it turns out refusing to blow is basically an admission of guilt and the judge did not like this. A year without a license, 52 weeks of once a week 1 hour counseling at $35 per week, a $1,500 fine and 3 weeks under house arrest was the result. Depending on what your BAC was a lawyer may help. If you're way over I think it's a waste of money.

I was hoping if I got a lawyer I might be able to keep my licence or get out of a jail sentence.

I am going to talk with one sometime next week, and see what they have to say, they may be worth it, or maybe I can get my parents to help me out with getting a lawyer, we will have to see what they say after I tell them, I keep trying to put it off, but have to tell them sooner or later.

Well said Marine. 1.8??? Christ I'm glad at least I or any of my family wasnt on the road with you that night. I mean, we have all driven home from a game or bar after a couple beers, I know that, but 1.8? Over twice the legal limit? Anyone else think that goes beyond "driving home after a couple?"

Just out of morbid curiosity, you got pulled over blew a 1.8 what happened then? Did you get booked? Im wondering how your parents couldnt know, I mean the cop didnt let you drive home, right?

Anyway, my advice is to get an attorney, and a good one. Judges may let you off at .08 or .09 but over twice the limit? I can look into some Nebraska case law if you want.

Any help is appriciated, I am not good with law, and don't know what I should do or plead or what.

After I got pulled over, he asked me to get in the back of his car for a few questions, and asked me some questions, and did some sobriety tests, did fairly good on most them but a few mistakes.

He ended up cuffing me and taking me to the hospital for blood samble, then we went to the court house so I could file more papers, and had to pay $250 bail cash that night, had a friend come pick me up and take me home.

Oh ya... and ontop of the DWI, they charged me with a spearate offence off driving on the curb when I sweared, and a no seatbelt charge. Passenger also got charged with open container.

Magic, the "driving on the curb" is the probable cause. They have to have a reason pull you over.

Lastly, GO AND GET A LAWYER. If you go to court with what you blew without an attorney, you are going to get jammed in the ass hard and dry. I don't care if you have to borrow the money to pay for one, it will be money well spent. Don't try and do this solo. Good Luck

Having a ball until someone whos been drinking blind sides a car and kills a loved one. Moms, dads and babies die every day cause of stupid drunks.

Drinking and driving, what is the limit 2/3/4/5 , 6 pack/12 pack don't know because i have been pulled over and charge with DUI after drinking 3/4 beers but also been pulled after drinking 10 and nothing done and took the breath test, and of course always get an attorney. The best advice of is do not drink , even one beer / drink and drive because sooner or later you will get caught and charged.

I was just looking for some help, why everyone have to always be ragging.

I talked with a few lawyers today.

With what I tell them happened, and becuase of my BAC was so high, I am looking f*cked. I could pay $750 for a lawyer, and might be able to only get 3 months suspension on my licence, and it looks like there probley is no loop holes in my case as I was clearly drunk and they have to much on me proving it.

So is it worth paying that money for a lawyer when no matter what I am going to still be paying about 600 or so plus have to take some alcohol classes?

I don't know... I will talk with a few more and see what the best option will be.

Save yourself some money and just stand tall before the man. Take your punishment, and move on with your life.

Let this be a lesson for all.

Hang in there guy, and get some help because you might have a problem. I'm not ragging on you, but that high of a BAC you should have been passed out on a floor somewhere.

So you F...ed up. More important that you learcn from your mistack. After my brush with the law I do not drink a beer and drive. Take a cab it is cheeper in the long run. Magic get in the classes right now. It will make a difference to the Judge. Also get a lawyer he or she will give you the representation you need. Try to have a lawyer reprent you that can speak to your character. Did the crime do the time. Keep your head up. Things will work out fine. We all make mistakes the trick is to learn from them.
