Didn't they video show them opening the door and letting everyone in?

WASHINGTON ? A federal judge ordered two alleged Capitol rioters and Proud Boys leaders into custody Monday ahead of their pending trial after prosecutors introduced new evidence about their involvement in planning the Jan. 6 attack.

Judge Timothy Kelly granted the government's request that Ethan Nordean, 30, and Joseph Biggs, 37, be detained, a reversal of a previous judge's order that allowed them to be released to home confinement.

Nordean, of Washington state, and Biggs, of Florida, are alleged to have conspired to hinder Congress' actions and obstruct law enforcement, along with destruction of federal property. Prosecutors claim they led some of the earliest individuals who breached the building that day.

"It?s no exaggeration to say that the rule of law, the durability of our Constitution?s order and in the end, the very existence of our republic, is threatened by such conduct," Kelly said.

Prosecutors argued earlier this month that their pretrial release should be revoked due to newly uncovered evidence including messages sent using the platform Telegram that they said showed the defendants were involved in planning the obstruction of Congress and law enforcement on the day lawmakers were set to certify the results of the 2020 presidential election.

That day, a mob of supporters of former President Donald Trump breached the Capitol, delaying the proceedings and threatening the lives of lawmakers and police officers. Five individuals, including Capitol Police officer Brian Sicknick, died as a result, and two other officers died by suicide in the aftermath.

Biggs is alleged to have entered, exited, and re-entered the Capitol during the riot and gotten as far as the Senate chamber. Nordean, for his part, also allegedly stole a flag from the building.

The judge cited profanity-laced social media posts and encrypted messages sent by the defendants, in which Biggs said it was time for "war" if Democrats "steal" the election and Nordean called for militia groups to contact him.

Though the evidence does not point to the defendants using direct physical violence against others on the day, Kelly said, their communications and movements before, during and after the riot showed they played a part in planning and leading the efforts that day, celebrated the events of the day and have not expressed remorse.

Kelly dismissed the defense's argument that the government had not provided compelling enough evidence that Nordean and Biggs presented an ongoing threat to the community, a condition for confinement.

He said the defendants' planning and organizing capabilities and their continued belief that the election was stolen means they had the potential to replicate their actions in their communities if released.

"Even if the election has passed, all of politics have not," Kelly said, arguing Nordean and Biggs could not be trusted not to access the internet or contact other extremist group members if ordered to do so without detention.

Another alleged co-conspirator, Charles Donohoe, is set for his own detention hearing later Monday afternoon.

The three men largely stuck together during the insurrection, which unsuccessfully sought to halt Congress?s certification of the Electoral College results from the 2020 presidential election, and assisted the mob?s efforts to advance through the complex.

Pezzola is also accused of confronting a Capitol Police officer and using the officer?s riot shield to smash a Capitol window.

News of Greene?s arrest comes the same day the Justice Department announced charges against four other people accused of assaulting officers during the Capitol riot.

Greene?s incarceration suggests prosecutors are ramping up their actions against the Proud Boys, a self-described ?pro-Western fraternal organization.? A number of other members of the group have also been charged, though not on conspiracy charges.

Conspiracy charges have also been announced against three members of the militia group the Oath Keepers over their alleged role in the chaos on Capitol Hill.

The case against Greene, Pezzola and Pepe is being prosecuted by the U.S. Attorney?s Office for the District of Columbia and the Department of Justice National Security Division?s Counterterrorism Section and is being investigated by the FBI?s Washington Field Office, as well as the Metropolitan Police Department.

Another four people associated with the right-wing Oath Keepers paramilitary group have been indicted in the federal conspiracy case regarding the Jan. 6 assault on the Capitol, according to newly unsealed documents.

Joseph Hackett, 50, of Sarasota, Fla., Jason Dolan, 44, of Wellington, Fla., and William Isaacs, 21, of Kissimmee, Fla., were three of the four added to the indictment, bringing the total number of Oath Keeper conspiracy co-defendants to 16 and overall number of those charged with conspiracy to 31.

The fourth name is redacted from the case file.

The four new defendants are charged with conspiracy to obstruct the certifications of the 2020 presidential election results by Congress as well as with the destruction of the U.S. Capitol and knowingly entering restricted areas in and around the Capitol.

Isaacs faces two more counts than Hackett and Dolan for civil disorder and aiding and abetting. Isaacs allegedly attempted to ?obstruct, impede, and interfere with a law enforcement officer? twice, including as officers were guarding the hallway between the Rotunda and Senate chamber during the attack.

All three ? Hackett, Dolan and Isaacs ? were arrested in Florida and face multiple counts. According to the indictment, they also took paramilitary gear, including firearms and supplies to Washington for the Jan. 6 Capitol attack.

The other 12 indicted Oath Keepers have pleaded not guilty. So far, only Jon Ryan Schaffer, an Oath Keeper member from Indiana, has pleaded guilty and agreed to cooperate with prosecutors in the Jan. 6 case.

Paul Hodgkins, a Florida man who waved a "Trump 2020" flag and took a selfie inside the Senate chamber on January 6, became the second defendant to plead guilty in the sprawling Capitol riot investigation.

Hodgkins initially faced a five-count indictment that included obstructing an official proceeding, entering and remaining in a restricted building or grounds, and disorderly conduct in a Capitol building, but he pleaded guilty Wednesday to just one charge of obstruction of an official proceeding, and the government agreed to dismiss his four other charges.

That charge carries a maximum possible penalty of 20 years imprisonment, but with his plea agreement, Hodgkins faces a recommended sentence of between 15 and 21 months.

In agreeing to plead guilty, Hodgkins also agreed to pay $2,000 in restitution. The government said the events of January 6 cost an estimated $1.4 million in repairs to the Capitol.

Hodgkins, a 38-year-old who works as a crane operator at a steel factory, wore a "Trump 2020" shirt January 6 and was one of a group of Capitol rioters who assembled at the front of the Senate chamber shouting in protest and prayer, as seen in a video taken by a New Yorker reporter during the siege.

In the video, Jacob Chansley, the so-called "QAnon Shaman," shouts prayers through a bullhorn and concludes: "Thank you for allowing us to get rid of the communists, the globalists and the traitors within our government. We love you and we thank you. In Christ's holy name we pray." Hodgkins raises his flag and nods to others in the room as they shout, "Amen."

Hodgkins was caught after a tipster called the FBI to say they recognized him in a selfie apparently taken at the Capitol. The tipster said they personally knew Hodgkins but had not spoken to him in several years, and a friend of a friend had found the photo on Parler, a social media platform popular with conservatives and members of the far right.


Prosecutors said Paul Hodgkins, 38, was caught after a tipster called the FBI to say they recognized him in a selfie apparently taken at the Capitol.

In video footage from the Capitol, prosecutors said, Hodgkins was also seen walking among the desks in the Senate, putting on protective eye goggles and taking photos on his cellphone.

Prosecutors said at one point, Hodgkins stood near a desk with paper on it and put on what appeared to be white latex gloves. His lawyer said Hodgkins put on the gloves to offer first aid to an injured man inside the chamber.

"The latex gloves were part of a first aid kit which I always carry in my backpack," Hodgkins said.

In an interview with the FBI, Hodgkins admitted to being on the Senate floor that day and said he had traveled alone by bus from Florida. He was initially arrested on February 16 in Tampa but had been released on a $25,000 bond while he awaited trial.

So far, only one other Capitol riot defendant, Jon Schaffer, has entered a guilty plea. Schaffer is a member of the Oath Keepers, which prosecutors say is a large, loosely organized collection of individuals and militias.

In pleading guilty, Schaffer agreed to cooperate and share information with prosecutors in exchange for a chance at a lower recommended sentence. The government has arrested at least 17 other alleged Oath Keepers, 16 of whom have been charged with conspiring to obstruct Congress's certification of the Electoral College vote.

Plea negotiations are underway in a number of other riot cases, but the magnitude of the investigation has complicated efforts to move forward with cases and secure plea deals.

According to 2019 Pew Research Center analysis, the vast majority of federal criminal cases ? around 90% ? end with guilty pleas rather than going to trial.

They are not in any of the 400+ indictments, I?ve checked them all. There?s not one frame of video not one still photograph on either of these men on the FBI?s webpage that ask people to give them tips on who the rioters were. The FBI?s YouTube channel or their Facebook page. They?re putting up all kinds of fuzzy pictures but they?re not putting up the HDI images that I sent them.?
