:nono: - depends on how he 'hired' her. If there was an offer letter or whatever, even if she is at will he needs to get her on payroll and do the payroll taxes. contractors vs. employees is a huge issue for the IRS recently.

good point on the other applicants though.

Ignore this

the following is an Old Cock dramatization:

~10 pm est

Betone: Hey, tax attorney girl, I?m online on this gambling message board bragging, I mean telling my boys about the great scheme I came up with.

Tax girl: What scheme? Who is this?

Betone: you know the one where I stick it to Obama and defer my salary this year!

Tax girl: Oh yeah, you called earlier.

Betone: So one of the guys is claiming I may not know what I?m talking about.

Tax girl: what guys?

Betone: Nevermind, just want to confirm that I have cracked the tax code and am all good with this.

Tax girl: sure

Betone: So what should I tell this guy?

Tax girl: What guy?

Betone: This knowitall from online

Tax girl: if he?s online talking about taxes he?s probably a dork, just say ?pussy? and distract him.

Betone: so call him a ?pussy?

Tax girl: sure, whatever, don?t call me this late, or ever again.

No official paperwork or contract, verbal hire. NC is at will.

Contacting CPA, thanks-

with no official paperwork I would worry about the DOL than. Just me though. Definitely contact someone you pay for advice on this.

Not to change the subject but has anyone been audited for gambling winnings? Do I really need a log of all my wagers?

Sure I got a payroll question, Mjs is great ( i do have a cpa for my corp and will be directing his way, but it's nice to get consistent answers)

Hired a woman for 1 day. Today. Found out during the course of the day she didn't have skills she said she did. Working interview ended today.

I obviously will be paying her for her time today.

Have not set up payroll yet, have not gotten w2 from her.

Can I just cut her a check and file a 1099?

You don't have to report her wages if less than $600 for the year. Forget the W2 and 1099 too.

This is factual info per my experience. I used to hire high scool students to perform data entry for large theft and fire UPP losses until my days of self employment ended abruptly in mid 2009. $600 was the threshold back then. If saint is paying $600 daily for clerical staff, I may be interested in his hygienist or office manager position.

It really seems that we can scratch payroll questions off of Poon's area of expertise
