I don't see how thats a spin. What I'm talking about is mental capacity and intent. I'm not saying she did or did not have the capacity because I was not in the courtroom nor did I hear the evidence. From a common sense point of view, I guess I am biased in thinking that anyone who kills there children is insane.
This is about capacity and intent. The negligence analogy was meant to show the differences between the two legal concepts. The result was the same, that is, 5 dead children. The means of death was different, one due to negligence of the mother, the other, as you mistakenly state was due to her intentional act.
My point was, and is, I'm not sure she had the capacity to form the requisite legal intent. Although this sounds like legal doublespeak (although as I'm typing it sounds that way to me). She's talkin about God and the devil etc. It's too crazy. Did she know she was killing her children, yes. Did she appreciate why she was commiting this horrendous act, I'm not sure.
Guys, by killing her, your doing her a favor. Letting her live with the possible eventual realization on her part as to what she has done is probably a more brutal, punishment. By the way, how many diseased mothers out there are thinking well I better not kill my kids or I may get the death penalty. Respectfully, I believe none. Its not a deterrent boys.
Do you really think I like child molesters, rapists etc. to be on the streets. If so, you really are not gettting my message.
